Assemblywoman Sally Lieber (D - Mountain View) has introduced CPF-supported legislation, AB 419, which would repeal Labor Code Section 4850 and give disability safeguards to firefighters who are currently exempted from these programs.
Currently, "4850" time in only available to those safety officers who are members of the California Public Employees Retirement System (CalPERS), the Los Angeles City Employees Retirement System , or subject to the County Employees Retirement Law of 1937. There are a number of firefighters who work within the state of California, but are not included in this group. A firefighter is a firefighter, regardless of their uniform, and it is important to include them in the application of the disability safeguards awarded under Labor Code Section 4850.
AB 419 has been approved by the Assembly and Senate and is now headed to the Governor's Desk for final approval. The Governor vetoed AB 419 on September 30, 2008. In his veto message, the Governor expressed concern with the bill's price tag and impact on local control.
